General Terms of Use

1. Purpose and acceptance

These General Terms govern access to, browsing of and use of the public website https://vitefix.com/ (the ‘Website’) and the VITEFIX assistant and portal available at VITEFIX (access restricted to authorised users) (the ‘Platform’), both operated by PRAGMANTIC PARTNERS, S.L. (‘PRAGMANTIC’). VITEFIX is the trade name of the digital solution and associated services offered by PRAGMANTIC.

For the purposes of these General Terms:

Accessing the Website confers Visitor status and implies full and unreserved acceptance of these General Terms in the version published from time to time.

If the Visitor disagrees with any provision of these General Terms, they must refrain from accessing, browsing or using the Website.

PRAGMANTIC may amend these General Terms. Visitors are invited to consult the version published on the Website. For the Platform, any material change to the terms of use will be notified to the Client before it takes effect, specifying the effective date and any applicable contractual rights, unless a legal or security emergency justifies immediate implementation and notice as soon as possible. Commitments under the agreed contract remain applicable. For the Platform, expressly agreed Special Terms prevail in the event of a conflict with general or specific terms. The Specific Terms of Use for VITEFIX AI Features prevail over these General Terms solely in respect of AI features. The Data Processing Agreement prevails in respect of processing carried out on behalf of the Client. These rules apply subject to mandatory provisions and do not diminish Data Subjects’ rights.

2. Identification of the information society service provider

In accordance with Article 10 of Spanish Law 34/2002 of 11 July on information society services and electronic commerce, users are informed that the owner of the Website and the Platform is: (BOE)

3. Website and Platform

The Website https://vitefix.com/ is primarily informational, corporate and commercial in nature. It is intended to present VITEFIX, describe its features, receive requests for information or demonstrations, and manage professional or business relationships.

The Platform VITEFIX (access restricted to authorised users) is the restricted-access digital environment through which the features associated with VITEFIX are provided to Clients and authorised Users. Provisions relating to the Platform apply to Clients and authorised Users; provisions relating to the Website apply to Visitors. The Platform’s AI features are also governed by the Specific Terms of Use for VITEFIX AI Features.

Access to the Website is generally open and free of charge, without prejudice to connection costs charged by the telecommunications provider engaged by the Visitor.

Access to the Platform is restricted to authorised Users and may require authentication, access controls and enhanced security measures.

4. Intellectual and industrial property

All content on the Website and the Platform, including, without limitation, text, documents, drawings, structure, navigation architecture, source code, object code, interfaces, databases, images, graphics, icons, logos, distinctive signs, trademarks, trade names, videos, audio, software, features, documentation and any other protectable elements, belongs to PRAGMANTIC or is used under the relevant authorisation or legal entitlement.

All intellectual and industrial property rights in such content are reserved. This reservation does not cover data and content provided by the Client or its Users, rights in which remain with their lawful holders. Rights of use strictly necessary to provide the service are reserved. Inputs and Outputs of AI features are governed by Article 10 of the Specific Terms of Use for VITEFIX AI Features. The prohibitions below do not restrict the rights thus granted to the Client.

No right to exploit, reproduce, distribute, communicate to the public, adapt, make available or reuse such content, or any other right in it, shall be deemed transferred to the Visitor or User, except to the extent strictly necessary for legitimate use of the Website or Platform in accordance with its purpose.

In particular, the following are prohibited unless PRAGMANTIC gives prior express written authorisation:

5. Conditions for using the Website and the Platform

The Visitor and, where applicable, the User undertake to use the Website and the Platform in accordance with the law, good faith, public policy, generally accepted practices and these General Terms.

The Visitor and the User are each liable for damage arising from a breach of their respective obligations. The Client’s responsibilities in relation to the Platform remain governed by the applicable contract.

6. Personal data protection

PRAGMANTIC will process personal data in accordance with applicable data protection legislation, including the GDPR and the Spanish LOPDGDD.

Detailed information on personal data processing, purposes, legal bases, retention periods, recipients and the exercise of rights is set out in the VITEFIX Privacy Policy.

7. Cookies

The Website may use cookies and similar technologies in accordance with applicable law and the relevant Cookies Policy. As at the revision date of these General Terms, the VITEFIX Platform available at VITEFIX (access restricted to authorised users) does not use cookies. Website cookies must not be confused with the Platform’s access and security mechanisms.

Specific information on cookie categories, consent management, rejection or configuration mechanisms and any third-party cookies is set out in the Website Cookies Policy.

The Spanish Data Protection Agency publishes a specific guide on the use of cookies, which serves as an interpretative reference on this subject (aepd.es).

8. External links and third-party content

The Website may contain links to third-party pages, platforms or resources. Such links may be provided solely for informational or functional purposes or for the Visitor’s convenience.

9. Disclaimer of warranties and limitation of liability

The Website and the Platform are provided ‘as is’, to the extent permitted by applicable law.

PRAGMANTIC makes reasonable efforts to ensure that the content, features and services offered are accurate, understandable, useful and reasonably up to date. However, PRAGMANTIC does not absolutely guarantee:

Nothing in these General Terms excludes or limits PRAGMANTIC’s liability where such exclusion or limitation is not permitted by applicable mandatory law. Commitments expressly undertaken towards the Client, particularly regarding availability, security and data protection, remain applicable.

10. Security and misuse

The Visitor and the User must refrain from any action that compromises the security, integrity or availability of the Website, Platform or PRAGMANTIC’s systems.

In particular, the following are prohibited:

PRAGMANTIC may take any technical, organisational and legal measures it considers necessary to protect its systems, including temporary or permanent suspension of access, preservation of evidence and reporting to the competent authorities.

11. Commercial communications

PRAGMANTIC will not send commercial communications electronically in breach of applicable law.

For this purpose, communications necessary to maintain the contractual relationship, provide the service, manage VITEFIX technically or operationally, ensure account security, handle incidents or properly perform the existing relationship with the Client or User are not considered commercial communications.

The rules governing commercial communications sent electronically are set out in the Spanish LSSI, which generally prohibits unsolicited advertising or advertising that has not been expressly authorised, except where legally permitted. (BOE)

12. Changes, suspension and removal of content

PRAGMANTIC may amend, update, remove, restrict or suspend the Website’s content and configuration. For the Platform, changes and suspensions will comply with the agreed contract and the notice arrangements in Article 1, particularly where they materially affect the service. Urgent measures necessary for security or legal compliance may be implemented immediately, with notice to the Client as soon as possible.

PRAGMANTIC may also restrict or deny access to the Website or Platform to anyone who breaches these General Terms, misuses the services or endangers the security, integrity or reputation of PRAGMANTIC or third parties.

13. Language

These General Terms may be published in several languages. In the event of any discrepancy, contradiction or difference in interpretation between versions, the Spanish version shall prevail.

14. Governing law and jurisdiction

These General Terms shall be governed by and interpreted in accordance with Spanish law.

For any dispute arising in connection with access to, browsing of, use of or interpretation of the Website, Platform or these General Terms, the parties submit to the jurisdiction of the courts of Vitoria-Gasteiz, Álava, Spain, expressly waiving any other jurisdiction to which they might otherwise be entitled, unless mandatory law provides otherwise.

15. Out-of-court resolution of consumer disputes

Regulation (EU) 2024/3228 repealed the framework for the former European Online Dispute Resolution (ODR) platform, which ceased operating on 20 July 2025. The European Commission currently redirects users to the Consumer Redress in the EU portal, where information on complaint procedures and alternative dispute resolution bodies is available (EUR-Lex).

Where applicable, consumers may obtain information about alternative complaint mechanisms through the official channels currently available in the European Union and Spain.
